releasing lands

Tipperary

My ancestors William Woodward the elder and William Woodward the younger lived at Cloghprior in Co Tipperary in the 1700's

I have transcriptions of deeds mostly dated 1774 whereby they release (or sometimes granted) Cloghprior lands to other gentlemen

Eg "22 June 1774 William Woodward the father released unto William Woodward his son part of the middle Division of Cloghprior 157 Acres for ever"

and "20 June 1774 William Woodward the father, his wife and son granted to John Levinge and Paul Rogers lands of Cloghprior and Ballybeg upon trust"

My questions are  - do these deeds mean that the Woodwards were leasing lands to  to these others?

Sometimes the deeds conclude with the words "in trust". what does this mean?

Helen,

To know exactly what was taking place with the land grants, it would be necessary to read the full terms of the deeds. They should specify the detailed terms and conditions. If there’s a consideration (a payment) involved then that points to a sale or lease.

A general definition of a trust (taken from the internet): “In a trust, assets are held and managed by one person or people (the trustee) to benefit another person or people (the beneficiary). The person providing the assets is called the settlor. Different kinds of assets can be put in trust, including: cash. property.”

In my experience, trusts were often established on behalf of minors (who did not have capacity to manage their affairs till they came of age), or for someone who was incapacitated in some way, or absent abroad, and again could not manage their own affairs. Nowadays trusts can also be used as part of tax avoidance arrangements.

Hi Elwyn

I don't have access to the full deeds. All I have is transcriptions made by my great uncle and his father-in- law, two of which I wrote out in full. I do know that the Woodwards were heading for financial disaster as soon after that they sold some land to James Otway and later became insolvent and sold the rest of the property. So I am guessing that William was leasing land possibly to gain cash. After all these also could be lease renewals.

Helen,

The Registry of Deeds records are available free on Familysearch:

https://www.familysearch.org/en/search/catalog/185720?availability=Family History Library

You need to search the Lands Index for Co Tipp years 1739-1810. Townlands beginning with the letter C start at page 80 and run through to around page 136. You need to search them for Cloghprior and events involving Woodward. I can see 3 on page 97 eg Woodward to Otway; Woodward to Falkiner & Woodward to Woodward. There may be others but I don’t really have the time to go through every page. Searching the index throughly may take about an hour.

Take the reference numbers given in that index and use them to look the actual deeds up.  The handwriting is very hard to read. Not an easy task. It may take a bit of time.
